1. THE PARTIES TO AGREEMENT
The Terms and Conditions herein apply to anyone using the NHS Discounts Portal: DiscountsHealthService.com website. The parties to the Agreement are DiscountsHealthService.com website, NHS ID Cardholder, and fm NHS Gold Cardholder.
2.1 “DiscountsHealthService.com” (hereinafter referred to as ‘the Website’) is an NHS Discounts Portal of participating companies/businesses offering a discount or service to an NHS ID Card or fm NHS Gold Privilege Cardholder. The Website is operated by first medical (hereinafter referred to as ‘We’ or ‘us’), a company registered in England and Wales, Company Registration Number 05151776. Our Registered Office is 20-22 Wenlock Road, London, England, N1 7GU.
2.2 An’ NHS ID Card means an NHS ID Card issued to an NHS employee by the Health Service (NHS/Trusts/CCGs).
2.3 A ‘fm NHS Gold Privilege Card’ (hereinafter referred to as a ‘Gold Card) means a first medical NHS Gold Privilege Card issued by NHS Trusts/CCGs/DiscountsHealthService.com/first medical/Healthcare Discounts/any Company contracted by first medical.
2.31 A ‘Gold Card purchased for £4.99’ means a Gold Card priced at a promotional price without an expiry date.
2.4 A ‘Company/business/Organisation’ (hereinafter referred to as a ‘Merchant’ ) is an advertiser within the Website.
2.5 ‘Exclusive Discounts/Services’ (hereinafter referred to as ‘Offers’) are Exclusive Discounts available on presentation of an NHS ID Card or a Gold Card.
2.6 An NHS ID Cardholder and or Gold Cardholder using the Website after registering will automatically be deemed a ‘Member’.
2.7 ‘We’, ‘Us’ means DiscountsHealthservice.com’ (the Website) operated by first medical.
2.8 ‘You’ means the’ NHS ID Card holder or Gold Card’ under this Agreement.
2.9 ‘Transaction’ means any payment paid for Goods and Services
3. THE USE OF DISCOUNTSHEALTHSERVICE.COM BY THE NHS ID CARD OR FM GOLD CARDHOLDER TO OBTAIN DISCOUNTS
3.1 You must register to access Offers on the Website and receive ongoing Offers not available to non-members. On the landing page of the Website, you have agreed to be bound by these Terms and Conditions in their entirety. Do not use this website, if you do not agree with any of the Terms and Conditions.
3.2 Offers within the Website are only available on the presentation of an NHS ID card or a Gold Card. Any other form of ID is invalid.
3.21 As an NHS employee, you can use your NHS ID Card to obtain Offers from the Merchants within the Website after registering. You must comply with all the Terms and Conditions when using the Website.
3.22 The Gold Card is strictly for the member’s personal use within the Website and is not transferable.
3.3 You, by using the Website after registering for any reason, will be deemed a ‘Member’ who has joined to access Offers from participating Merchants on presentation of an NHS ID Card or a Gold Card.
3.4 A number of Merchants have presently agreed to only offer discounts to NHS Staff on the presentation of an NHS ID Card. These discounts are not available to Gold Card holders. When these discounts become applicable to Gold Card holders, the discounts will be updated automatically on the Website.
3.41 A number of merchants have agreed to pay first medical a commission when members purchase from them.
3.5 We reserve the right to update or amend these Terms and Conditions at any time. Once the changes have taken place, you by continuing to use the Website will be deemed as your acceptance of changes that have been made. At all times, it is the Members’ responsibility to check on a regular basis for any changes to the Terms and Conditions. We will not be held responsible in this regard.
3.6 Although you may use the Gold Card, all Gold Cards will at all times remain the property of first medical. This means you must give the Gold Card back if we ask you to do so. A Merchant or any person acting on behalf of first medical can also keep the Gold Card on our behalf. You must not use the Gold Card if it has been withdrawn or cancelled.
3.71 The Website displays Offers as instructed by the Merchants. The Merchants can withdraw or change their Offers at any time without giving any notice to the Members. We cannot be held responsible for any errors, incorrect Offers, or the Merchant not upholding the Offer on the Website.
3.8 At all times, it is your sole responsibility as an NHS ID Card or a Gold Cardholder to evaluate the nature of the Offers available to you, prior to concluding any Transaction with the Merchants within the Website. We will not be held responsible in this regard.
3.81 You must check the conditions of each offer carefully.
3.9 Restaurant offers are available for walk-ins and bookings made directly with the restaurant unless otherwise stated.
- Restaurant offers are not valid in conjunction with any other Promotions unless otherwise stated
- Restaurant offers are only valid between Monday – Thursday unless otherwise stated.
- Restaurant offers are only valid on FOOD only – NOT on drinks unless otherwise stated.
- Please inform the Restaurant that you are an NHS ID Card/Gold Cardholder when making a booking.
- Please inform the Restaurant that you are an NHS ID Card/Gold Cardholder prior to asking for the bill.
- Restaurant offers are not normally valid on Bank Holiday, Christmas Day, Boxing Day, Easter Sunday, Mother’s Day, Father’s Day, New Year’s Day, Valentine’s Day unless otherwise stated.
- DiscountsHealthService.com cannot be held responsible if a Restaurant does not uphold the offer stated on DiscountsHealthService.com.
- Restaurant offers are only valid on a la carte menu unless otherwise stated.
4. BUYING THE GOLD CARD
4.11 The Gold Card is normally valid for 365 days. For a limited period, the promotional Gold Card is currently available without an expiry date for £4.99 per Card plus £2.25 p&p: The total amount you will pay is £7.24. We reserve the right to change the postage charge at any time without further notice.
4.14 We aim to deliver your Gold Card via Royal Mail within 7 days days of eceiving your order.
4.13 You will automatically be deemed to be a member upon purchasing the the Gold Card or the special Gold Card.
4.15 You must tell us immediately about any change of your email address to: email@example.com.
4.16 If you are buying a Gold Card for someone else, that person is deemed to be a member upon you purchasing the Gold Card.
4.17 When the limited period of purchasing the promotional Gold Card has ended, it will be stated on the Website. The price of a Gold Card purchased after the expiration of the promotional period will then be £9.99 and the Gold Card will then automatically renew 365 days after the purchase date, at a cost of £9.99. If you require a replacement Gold Card when renewing. There will be an additional cost of £7.24 including p&p. The total cost will be £17.23 (if the purchase price of the Gold Card is listed as £4.99 otherwise, you will pay the price and the postage listed on the Website. If you do not agree with this statement, do not buy.
4.18 We will email you a reminder seven days before the end of the subscription period. You will be advised of the new details of the new subscription, how to cancel, and the cancellation period within which this must be done. Cancellations after this date will incur a £4.99 admin Fee.
4.19 We will not be liable for any non-receipt of email from us.
4.20 In the event you lose your promotional Gold Card purchased for £4.99 after the promotional period has ended you will then have to pay the replacement price of the Gold Card listed on the Website. The replacement Gold Card will have an expiry date of 365 days and thus automatically renew 365 days after the purchase date, at a price listed on the Website at the time of renewal. If you do not agree with this statement, do not buy.
4.21 When renewing your Gold Card, you must read the Disclaimer and the Terms and Conditions before buying. We reserve the right to request additional proof to confirm that you are the owner of the Gold Card you are renewing. In the event, it is found that the information entered when renewing is incorrect and you are not the owner of the Gold Card for whatsoever reason, we reserve the right to refuse you access to this Website, refuse to issue a Gold Card, and not liable to refund you any monies. If you do not agree with this statement, do not buy.
4.21 A refund for a returned Gold Card will only be valid if the Gold Card is returned to us via recorded delivery within 7 days of receipt, less an admin fee of £4.99
4.3 A number of Merchants are only offering incentives to NHS Staff on the presentation of an NHS ID Card. These stipulations are stated in the business listings of the said Merchants. These discounts are not available to the Gold Card holders. If you do not agree with this statement, do not buy.
5. THE ACCOUNT
5.1 You must not allow anyone else to use the Gold Card.
5.2 If your Gold Card is misused with your permission, your Gold Card and any additional Gold Cards you have been issued /purchased/hold will automatically be cancelled.
5.3 You must tell us immediately about any change of address by e-mailing to: firstname.lastname@example.org
6. THE FEES
6.1 The Fee of Gold Card is listed on the Website prior to you making the payment. You must read the Terms & Conditions before buying the Card so you are aware of the stipulation set out by the Merchants and us. If you do not agree with this statement, do not buy.
6.2 Where the Gold Card has been issued by the employer, you must activate your Gold Card within 30 days of its receipt by the employer. The Fee to activate a Gold Card is £1.49
6.3 We reserve the right to cancel any Gold Card and request its return in the absence of registration within 30 days of its receipt by the employer without further notice.
7. ENDING THIS AGREEMENT
7.1 You can end this Agreement at any time by returning to us Gold Card(s)/special Gold Card(s) (cut in half) via Recorded Delivery with a letter addressed to the issuing company: first medical, 20 – 22 Wenlock Road, London N1 7GU The Agreement will only cease when we receive the Gold Card(s) issued to you.
7.2 We can end this Agreement and ask you to return your Gold Card at any time by giving immediate notice to you but unless there are exceptional circumstances we will give you 30 days notice.
7.3 If we have a good reason we may also without telling you first and without incurring liability for loss or damage to you or an additional Gold Cardholder suffers, as a result, stop you from using the Gold Card or refuse approval of a Transaction.
8. PROTECTING YOUR GOLD CARD
8.1 You must take proper care and ensure the Gold Card is safe to stop anyone else from using it.
8.2 If you lose the Gold Card, it is stolen or damaged you must: email us immediately to: email@example.com. The price we will charge you for the replacement of your Gold Card will be the same as the price listed on the Website for the purchase of a Gold Card.
8.3 You must tell us immediately about any change of address or if your mobile number changes.
9.1 We are not responsible for any non acceptance of the NHS ID Card/Gold Card or the manner in which the Gold card is accepted or not accepted.
9.2 We are not responsible nor liable either in contract, tort (including negligence) for any failure to carry out any of DiscountsHealthservice.com’s obligations under this Agreement if this is because of industrial dispute, data processing failure, force majeure, systems failure or any other event outside First Medical Ltd’s reasonable control.
9.31 We are not responsible nor liable for direct or indirect loss of profits, business or anticipated savings nor for any indirect, special or consequential damages for any destruction of date or arising under this Agreement.
9.32 We exclude all liability of any kind in respect of the following:
9.33 Any material on the Internet which can be accessed via the Website. However, we are not responsible in any way for any goods (including software) or services provided by third parties advertised, sold, or otherwise made available by means of the Service or on the Internet;
9.34 The accuracy, completeness, or suitability for any purpose of any Content.
9.45 We are not responsible nor liable, either in contract, tort (including negligence), or otherwise for the acts or omissions of other providers of goods or services or for faults in those goods or services.
10. COMPLAINTS PROCEDURE
10.1 The transaction taking place is directly between you and the Merchant at all times. The legal obligations for the transaction remain the responsibility of the Merchant.
10.2 Should any disputes arise in connection with a transaction, they should only be resolved between the parties directly. However, providing you have registered as required under this Agreement prior to making the transaction in dispute; where we can, we will endeavour assist you to resolve the dispute. We can be contacted via Recorded Delivery letter at our address in section 2.1 or at firstname.lastname@example.org.
10.3 We will not be liable for any non-receipt of email from us. We advise you to contact us in writing via Recorded Delivery letter to ensure we receive your communication.
11.1 Information within this Website is provided “as is”, We make no warranties, express or implied as to the correctness of the information presented, and shall not be liable for any inconveniences, losses of revenue, consequential damages of any kind, resulting from the direct or indirect use of this information presented within the Website.
11.2 We grant the Gold Card holder permission to use the information for personal use only, and such results may not be copied, reused, modified, manipulated, or transmitted without the express permission of first medical.
11.3 Mention of Companies, businesses, firms, products, organisations, or persons within the Website is for information purposes only and constitutes neither an endorsement nor a recommendation. All brands, products, trademarks, and service names mentioned within the Website are the property of their respective owners.
11.4 We and the participating NHS Trusts will not be held responsible for any financial matters incurred by the NHS employees and Gold Card holders for whatever reason. it is your sole responsibility as an NHS ID Card or a Gold Cardholder to evaluate the nature of the Offers available to you, prior to concluding any Transaction with the Merchants within the Website.
12.0 LEGAL STATEMENT
12.1 DiscountsHealthService.com provides NHS Staff and Healthcare sector access to Exclusive Discounts free of charge on the presentation of their NHS ID Card upon registering with an NHS email.
12.2 Non-NHS Staff can access DiscountsHealthservice.com by purchasing a Gold Card which at all times remains the property of the issuing company.
12.3 DiscountsHealthService.com has taken every care in the preparation of the content of this site. DiscountsHealthService.com disclaims all warranties, express or implied, to the fullest extent permitted by law, as to the accuracy of all information contained herein.
12.4 DiscountsHealthservice.com is not liable for any loss or damage arising from the use of any information contained on this website. Hypertext links in this site will lead to websites that are not under the control of DiscountsHealthservice.com. Furthermore, DiscountsHealthService.com accepts no responsibility or liability in respect of the material on any website which is not controlled by DiscountsHealthservice.com.
12.5 The Website and all the text layout information or graphics contained in the Website belong to DiscountsHealthservice.com in the absence of any indication to the contrary.
